What is the Pillar Two simplified ETR safe harbour?
By election, top-up tax is nil where a jurisdiction's simplified ETR, from reporting-package figures, is at least 15%, or it has a simplified loss.
Per Side-by-Side Package, January 2026, Chapter 2, Simplified ETR Safe Harbour
At the election of the Filing Constituent Entity, the Top-up Tax in a Tested Jurisdiction for a Fiscal Year is deemed to be zero where the Tested Jurisdiction has a Simplified ETR of at least the Minimum Rate, calculated by dividing the Simplified Taxes by the Simplified Income, or has a Simplified Loss. Simplified Income or Loss is the Jurisdictional Profit or Loss before Income Tax after Basic, Industry, Conditional and any Optional Adjustments; Simplified Taxes are the Jurisdictional Income Tax Expense after the adjustments the safe harbour prescribes. An MNE Group may elect it for a Tested Jurisdiction for the first time, or again after failing to qualify, only if it had no Top-up Tax liability for that Tested Jurisdiction in every Fiscal Year beginning within the published number of months before the first day of the Fiscal Year.
A group with ordinary tax rates in a jurisdiction can show it from its reporting packages and stop there, without the full GloBE computation.
Two figures, one division, and conditions on who may elect
The test
- A Simplified ETR at or above the Minimum Rate — or
- A Simplified Loss
Simplified Income
Jurisdictional Profit or Loss before Income Tax — the aggregate Financial Accounting Net Income or Loss of the entities plus their income tax expense — with Excluded Dividends and Excluded Equity Gains or Losses removed and illegal payments and large fines added back; industry adjustments for insurance, Tier One capital and shipping; conditional adjustments for equity-reported items and M&A; and any optional adjustments elected. The fines threshold is higher than under the full rules.
Simplified Taxes
Jurisdictional Income Tax Expense, current and deferred, less tax that is not a Covered Tax and tax on income outside Simplified Income; adjusted for refunds, credits and uncertain positions; with deferred tax recast at the Minimum Rate and valuation allowances ignored. Deferred tax liabilities that are not Recapture Exception Accruals are left out, and the recapture rule generally does not run.
The Tested Jurisdiction
The entities for which the GloBE Rules require a separate rate. By Annual Election, ordinary Constituent Entities and same-country Investment Entities in a jurisdiction may be tested together.
Who cannot elect
- Stateless Constituent Entities, save as the package provides
- Investment Entities, save as the package provides
- A jurisdiction with an Eligible Distribution Tax System election and an outstanding recapture account balance
First election and re-entry
No Top-up Tax liability in the jurisdiction in any Fiscal Year beginning within the look-back period — under the full rules or a Specified Safe Harbour.
Integrity rules
The figures must respect four principles, including matching of intragroup income and expense, full allocation of income, and deducting each expense or loss once.

An ordinary-rate jurisdiction
Simplified Income of EUR 10 million and Simplified Taxes of EUR 1.64 million.
Computed
Meets the Simplified ETR test as computed — 16.4% against a Minimum Rate of 15% for FY2027: Simplified Taxes of EUR 1,640,000 on Simplified Income of EUR 10,000,000. The Top-up Tax for the Tested Jurisdiction is deemed to be zero at the election of the Filing Constituent Entity (Box 2, paragraph 1(a)), provided the Simplified Income and Simplified Taxes were computed with the package's adjustments and integrity rules. Based on the figures you supplied.

A jurisdiction just short
The same income with Simplified Taxes of EUR 1.4 million.
Computed
Does not meet the Simplified ETR test as computed — 14% against a Minimum Rate of 15% for FY2027: Simplified Taxes of EUR 1,400,000 on Simplified Income of EUR 10,000,000. The safe harbour does not apply for the Fiscal Year; the full computation, or another safe harbour, applies, and re-entry is subject to the look-back. Based on the figures you supplied.

A loss-making jurisdiction
A Simplified Loss of EUR 2 million.
Computed
The Simplified ETR Safe Harbour is met as computed: the Tested Jurisdiction has a Simplified Loss of (EUR 2,000,000), so its Top-up Tax for the Fiscal Year is deemed to be zero at the election of the Filing Constituent Entity (Box 2, paragraph 1(b)). The package's simplified adjustment for negative taxes in a loss year is not computed here. Based on the figures you supplied.

Top-up tax paid last year
A jurisdiction where the group had a Top-up Tax liability in the preceding Fiscal Year.
Computed
The Simplified ETR Safe Harbour cannot be elected for the Tested Jurisdiction for the Fiscal Year as computed: the MNE Group had a Top-up Tax liability there in a Fiscal Year beginning within 24 months before the first day of the year, and a first election or a re-election requires none in every such year. Based on what you supplied.

1 input still need your determination:
- Does the Filing Constituent Entity elect the Simplified ETR Safe Harbour for the Tested Jurisdiction for the Fiscal Year?
Computed in your browser from the figures you supply. Nothing is sent anywhere, and the result is a computation against a rule — reference, not tax advice.
